Under Code § 105-108 every person (including corporations) is liable for torts committed by his servant within the scope of his business, whether the same shall be by negligence or voluntary. The test is not whether the servant’s act is wilful, malicious or unjustifiable, but whether it is done within the range of the employment and for the purpose of accomplishing a business authorized by the employer.
