ORDER DISMISSING COUNT I OF THE THIRD AMENDED COMPLAINT

THIS CAUSE came before the Court upon the parties’ post-trial memoranda regarding disposition of Count I of the Third Amended Complaint [D.E. 223, 233, 336]. For the reasons stated below, the Court dismisses Count I as moot and denies Plaintiff 200 Leslie Condominium Association, Ine.’s (“200 Leslie”) request for an order establishing that it is the prevailing party as to Count I for purposes of an attorney’s fees award.
