This suit was brought in the circuit court of Wyoming County by Bluefield Supply Company against M. P. Smith Construction Company, Nelson and Chase & Gilbert Company, Virginian & Western Railway Company arid Hartford Accident & Indemnity Company. The suit seeks recovery upon a bond given pursuant to section 22, article 2, chapter 38 of the Code by Nelson and Chase & Gilbert Company, as principal contractor, and Hartford Accident & Indemnity Company, as surety, to Virginian & Western Railway Company as the owner of premises upon which a railway grade and certain tun- ' neis were…
