This suit was in assumpsit, commenced by the plaintiff in error against the defendant in error in the circuit court, May 5, 1880, and was based on a joint and several promissory note, dated Council Bluffs, May 4, 1870, given by W. It. Craig as principal, and the defendant in error as surety, for $800, one day after date, payable to P. M. Spencer, with 10 per cent, interest from date, and indorsed by Spencer to Miller.
