The complaint alleges that the plaintiff, Hughes Fawcett, is, and at all the times therein mentioned had been, carrying on business under the name of the Robert Andrews Company, and that he is, and at all such times was, the sole owner of the business known as the Robert Andrews Company; that in March, 1905, he caused to be “ filed in the office of the Clerk of New York County a certificate to do business under the firm name and style of the Robert Andrews Company, under and pursuant to the Penal Law of the State of New York, and ever since said date and up to the present time…
