WALKER, Chief Justice.

This appeal comes to us as a result of judgment rendered by the 1-A District Court of Newton County, Texas. Trial was before a jury which awarded appellee title to land and damages for loss of timber.

Judgment was signed February 2, 1990 and Motion for New Trial was denied March 14, 1990. Appeal has been duly perfected to this Court. Factually, on August 16, 1987 appellant Ramsey, by deed from Elmer Simmons, obtained 22 acres of land out of the James Lewis Survey in Newton County, Texas.
