This matter arises upon exceptions to the schedule of distribution in the auditor’s report in the estate of George W. Smyers. The controversy is as to the ownership of a fund admittedly held by the decedent as trustee. The decedent was a member of a lodge known as the Harry Goode Lodge No. 307 of the Ancient Accepted Scottish Rite Universal Freemasonry, from which he received the funds in question which were deposited in the Du Bois National Bank in the name of George W.
