This was an action of trespass by an employee against his employers, to recover damages for personal injuries, sustained in the course of his employment, through the alleged negligence of the employers. The facts, substantially as stated by the trial judge, were as follows : The defendants, Morris Boney & Son, were stevedores. The plaintiff, Bernard McGeehan, a laborer in their employ, was injured by iron ore falling upon him from a tub or bucket hoisted from the hold of a vessel where he was employed with other men who were working for defendants.
