Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered May 10, 2006, convicting defendant upon his plea of guilty of the crime of sexual abuse in the first degree.

In 2005, this Court reversed defendant’s convictions of forcible touching and sexual abuse in the first degree, and remitted the matter for a new trial (19 AD3d 736 [2005]). During jury selection, defendant advised County Court that he wished to accept the plea offer that had been extended to him.
