This appeal is from a conviction of the appellant as an accessory before the fact to the crime of robbery; whereupon he was sentenced to serve a term of five years in the state penitentiary.

On Saturday night, February 4, 1939, at about eleven o’clock, one Billy Moody, held up and robbed, by the use of a pistol, Grover 0. Carter, in his store located in the Wade community, about twenty miles north of Kreole, in Jackson county; and took, stole and carried away about $35 in money, and certain checks.
