Edward Spaeth by his will gave the residue of his estate to his executors in trust and directed that from the income thereof (and, if necessary, the principal), the sum of $5,000 be paid to his wife, Stella Spaeth, annually during her life and a like annual sum be paid to his daughter, Elizabeth Louisa Spaeth, the complainant (now Elizabeth S. Schumacher). He appointed his wife trustee to receive the income given to Elizabeth and to use it for her support and maintenance.
