This case is before us on demurrer to plaintiffs’ petition.

Plaintiffs allege that on November 18, 1940, they entered into a contract with the defendant for the construction of a reinforced concrete building known as the Astoria Control Station, Astoria, Oregon; and that on September 7, 1940, plaintiff David A.
