Appeal from a judgment of the County Court of Chemung County (Castellino, J.), rendered August 28, 1996, upon a verdict convicting defendant of the crime of promoting prison contraband in the first degree.

We affirm defendant’s conviction of the crime of promoting prison contraband in the first degree. The trial evidence discloses that on November 26, 1995 defendant was involved in an altercation with another inmate on the second floor of G block* in Elmira Correctional Facility in Chemung County.
