PARKER, Circuit Judge.
This is an appeal in an action instituted to recover a portion of the income and excess profits taxes paid by a corporate taxpayer for the years 1916 to 1919 inclusive. The judge below, who heard the case without a jury, made specific findings of fact in 24 separately numbered paragraphs and stated fully and specifically his conclusions as to the law governing the case.
