Plaintiffs in error, Taylor G. Vaughan and forty-six others, are resident voters, landowners and taxpayers of the town of Galax, an incorporated community lying in the counties of Carroll and Grayson.

On August 9, 1938, the town council passed an ordinance providing for the issuance of bonds in the sum of $158,000, for the purpose of erecting an electric generating plant and a distributing and lighting system for the town.
