Suit for the use of a materialman who furnished marble to a subcontractor for a United States Government hospital, against the surety on the bond of the subcontractor, was brought in the name of the trustee in bankruptcy of the main contractor, who was the obligee in the bond. The material facts are substantially as follows: The Jewell Riddle Company, the main contractor, had a contract with the Government for the construction of a hospital.
