Appellant Harry Robert Geuder was convicted by a jury of the felony offense of aggregate theft. Appellant pleaded true to two enhancement paragraphs, 1 and the jury assessed punishment at eighty years’ confinement in the Texas Department of Criminal Justice, Institutional Division. In our original opinion, we affirmed the trial court’s judgment without addressing the merits of appellant’s first point. See Geuder v.
