The defendant is charged with one count of criminal sale of a controlled substance in the third degree. A hearing was held to determine whether the defendant was arrested with probable cause, whether an identification of him by an undercover police officer following his arrest was lawfully conducted and whether property recovered from his person, a cell phone and prerecorded buy money, was lawfully obtained.
