OPINION

HAIRE, Judge.

In this special action, the petitioning father requested that we prohibit the respondent judge from proceeding further in Apache County Civil Action No. C-5560. Petitioner contended that his motion to dismiss should have been granted because exclusive jurisdiction was vested in the Maricopa County Superior Court. After hearing oral argument, we accepted special action jurisdiction and entered an order directing that the Apache County proceedings be dismissed. This opinion sets forth the reasons for our decision.
