On motion for new trial by the defendant. This is an action of assumpsit brought by the plaintiff to recover damages of the defendant for a breach of a promise of marriage, alleged to have been made by defendant to the plaintiff. The defendant pleaded the general issue. The jury returned a verdict for the plaintiff. Defendant filed a general motion for a new trial. The case is stated in the opinion.

This is an action for breach of promise of marriage. The plaintiff recovered a verdict for $116,000. The case comes before this court on the defendant’s motion for a new trial. The plaintiff in her writ alleged a promise on March 10, 1910, and another on November 6, 1910. And she testified that such promises were made. The defendant denies that he ever promised the plaintiff to marry her. And further he pleads, and relies upon as a bar, the unchastity of the plaintiff prior to the date of the first alleged promise, and between that date and'the date of the second alleged promise; and that,…
