This is an action of tort for the conversion of a quantity of wood and timber.
It appeared at the trial that one Warren, being the owner of a lot of wood-land, mortgaged it to the plaintiff’s testator; and that, after the condition of the mortgage was broken, but before the mortgagee had taken possession, Warren cut the wood and timber in question and sold it to the defendant.
