Reversing.
At tbe regular November election in 1944, appellee, W. D. Mullins, was elected a member of tbe County Board of Education for Rockcastle County. In January, 1945, he qualified ¿nd entered upon the discharge of the duties of his office. At that time the provisions of section 160.180 KRS’ wore in force and effect, a portion of which was and now is that:
“No person shall be eligible to membership on a board of education:
