Burr, J.:

The action was brought to recover damages for the death of plaintiff’s intestate. The jury rendered a verdict in favor of the plaintiff and against the defendant for the sum of $2,500.

It is alleged in the complaint that on or about October 4, 1920, Ashod Basmajian, a student of Public School No. 4, at One Hundred and Seventy-third street and Fulton avenue, borough of The Bronx, “ was lawfully playing in the playground of said school.” “ That at the times herein mentioned, the defendant, its servants and janitor, failed and neglected to cover, properly, the stone stairs and stairway…
