CHASE, Circuit Judge.

The appellant and seven others were tried on an indictment containing three counts. The first count charged that the defendants conspired together and with other persons unknown (a) fraudulently to import into the United States merchandise described as intoxicating liquors containing more than one-half of 1 per cent, of alcohol by volume which were fit and intended for use for beverage purposes, by bringing in such liquors without paying the customs duties thereon, without manifesting them, without declaring and entering them at the Customs House, and without inspection;…
