MEMORANDUM OF DECISION AND ORDER

SPATT, District Judge.

Presently before the Court is a motion by the pro se plaintiff James E. Flaherty (Flah-erty” or the “plaintiff”) pursuant to Federal Rule of Civil Procedure (“Fed. R. Civ.P.”) 60(b) for relief from the Court’s order dated November 14, 2003 dismissing the plaintiffs complaint for failure to prosecute.

I. BACKGROUND
