FOLLEY, Justice.

This is an appeal from a judgment in the sum of $700 in favor of the appellee, H. L. Stanton, against the appellant, Texas Employers’ Insurance Association, in a workman’s compensation suit filed by the ap-pellee by reason of injuries sustained by him from accidental burns on April 27, 1938, in Dickens County, Texas, while in the employment of James Spencer & Son Construction Company, a partnership of contractors engaged in highway construction work in Dickens, Oldham and Deaf Smith Counties, Texas.
