facts

In January, 1978, defendant was indicted by a Kings County Grand Jury and charged with the crimes of robbery in the first degree, robbery in the second degree, grand larceny in the third degree, and criminal possession of a weapon in the third degree. After all pretrial motions and hearings were concluded in April of 1979, defendant was tried by a jury commencing on May 4, 1979.
