This is an appeal from the judgment of the district court in favor of the appellees as defendants in a suit for infringement of appellant’s design patent, and for damages for unfair competition and an injunction. The court’s order was in form of a dismissal of plaintiff’s complaint on the merits based upon find ings arid conclusions of law by a special master, who found the patent infringed if valid, but then found the patent invalid.
