Alford Cunningham appeals from an order of the District Court dismissing his petition for a writ of habeas corpus without an evidentiary hearing.

Appellant had pleaded guilty to charges in several indictments in the Circuit Court for McCracken County, Kentucky, on May 23, 1967. After being sentenced to a total of 21 years’ imprisonment on his guilty pleas, appellant, on September 24, 1968, moved to vacate the judgment and sentences.
