This is the first case in which we have been asked, under the provisions of chapter 264 of the Laws of 1860, to review' questions of fact in a common law action, when the trial below was had before the court without a jury. The 13th section of1 that act provides, that when any issue of fact is tried by the court, either party, for the purposes of an appeal, may, within ten days after written notice of the entry of judgment, or without such notice, file with the clerk written exceptions to the facts found by the judge who tried the cause, or to his conclusions of law…
