— The purpose of this action is to procure a construction of a deed from John H. Pieper *212and Elizabeth Pieper, his wife, to their daughter, Clara A. Eves, and her children, as follows:

“This Indenture, made the twenty-ninth day of July in the year of our Lord, one thousand eight hundred and ninety eight, between John Pieper and Elizabeth Pieper of the first part of Multnomah Co., Oregon, and Clara A.
