This is a suit by the Attorney-General and the State Land Commissioner to cancel a forfeited tax land patent issued to one of the appellees by a former state land commissioner, on June 26, 1936, purporting to convey the state’s title to forty acres of land situated in Leflore County about 3% miles south of Itta Bena.
