These article 78 proceedings are brought by various patrolmen in the Police Department of the City of New York who took and failed the promotional examination held on April 12, 1969 for the position of sergeant. Broadly speaking, petitioners seek to vacate a prior order, entered April 26, 1972, which settled the case of Gilmartin v. Bronstein (Index No. 7966-71), then pending in this court.
