Charles A. Harrell, Sr. (Harrell) appeals a forcible detainer suit brought by Citizens Bank (Bank) alleging that his son and stepson own an interest in the property thereby creating a title issue which divested the trial court of jurisdiction to issue a writ of possession. Secondarily, Harrell urges that the Bank only owns an undivided interest in the property, that he occupies the property with the consent of the other owners and cannot be evicted.
