ORDER ON APPEAL FROM BANKRUPTCY COURT’S ORDER
DWYER, District Judge.
This is an appeal from an order of the United States Bankruptcy Court for the Western District of Washington holding that a bankruptcy estate owes no additional taxes, penalties or interest. In so holding, the court ruled that the gain on the sale of an individual Chapter 7 debtor’s residence is excluded from gross income of the debtor’s bankruptcy estate to the extent provided by 26 U.S.C. § 121. 1 The bankruptcy court entered a final order on August 10, 1998.
