In a negligence action to recover damages allegedly sustained as a result of a fire occurring at plaintiffs’ warehouse, defendant Commander Oil Corp. appeals from so much of an order of the Supreme Court, Nassau County (Vitale, J.), dated December 2, 1982, as granted that part of defendant Westbury Fire Department of the Westbury Fire District’s motion for summary judgment dismissing Commander Oil Corp.’s cross claims against it. Order affirmed insofar as appealed from, with costs. On February 25 and 26, 1980, a fire completely destroyed plaintiffs’ warehouse located in Westbury, New York.…
