This court’s original decision of this case appears in 131 C. Cls. 95. We rendered judgment in favor of the plaintiff. The Government filed a petition for certiorari to the Supreme Court, which the Supreme Court denied. The Government petitioned the Supreme Court for a rehearing, which was denied. After a decision in conflict with ours was rendered by the Court of Appeals for the Second Circuit in Commissioner v. National Lead Co., 230 F. 2d 161, and after this court had decided the case of Allen-Bradley Co. v. United States, 134 C. Cls. 800, in accord with its decision in the plaintiff’s…
