Defendant New York City Housing Authority (the Housing Authority) moves for an order: (1) pursuant to CPLR 3211 (a) *882(5) and (a) (7), dismissing the complaint of plaintiffs Citadel Estates, L.L.C.; Fortress Crotona, L.L.C.; Fortress 31, L.L.C.; and M.Z. Partners, L.L.C.
