This suit was brought by appellee to recover damages for injuries received by him while working in appellant’s coal mine.
The declaration contained three counts. The first charged wilful failure to regularly and thoroughly spray, sprinkle and clean the entry, galleries and road ways where appellee was employed and that the firing of shots in a certain entry ignited dust and caused an explosion which injured appellee; and the second, that the same duty existed on the part of appellant and that the firing of one shot ignited the dust and caused fire to communicate to the fuse of a second shot,…
