OPINION & ORDER
BASKIR, Judge.
Currently before the Court is Plaintiffs Application for Attorney Fees filed pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412. The Government moves to dismiss the Application on the ground that a provision set forth in the Consolidated Appropriations Act of 2008, Pub.L. No. 110-161, 121 Stat. 1844 (2007), strips this Court of jurisdiction to entertain the Application. The Government argues in the alternative that Plaintiff is not entitled to attorney fees.
