APPEAL by the plaintiff from an order made at a special term, authorizing the defendant, as receiver, to lease certain premises in the city of blew York, known as the Olympic Theater, to James E. Hayes, for the term of three years, from the 1st day of September, 1868.

Preliminarily to the argument of this appeal, the majority of the court decided that the papers handed or sent to the judge who made the order appealed from, upon due notice to the attorney for the defendant, after the argument and submission of the motion, had been properly printed as a part of the appeal papers, and were to be considered by the general term, in determining the questions presented by the appeal.
