Miles E. McGrew instituted this action, to recover damages for personal injuries allegedly occasioned by a defective and unsafe railroad-highway grade intersection causing the automobile he was operating to overturn. A ten-juror verdict was returned for $10,000. Judgment followed and Guy A. Thompson, as Trustee for the Missouri Pacific Railroad Company, appealed.
