This is an appeal by the Commissioner of Motor Vehicles of the State of New York from a decision and final order of the Special Term, which order instructed the appellant to lift the suspension of the petitioner’s operator’s license, and to restore and/or reissue to the petitioner the said license.

The facts upon which this appeal is based are these:
