These parties appear in the same order as in the trial court and are hereinafter referred to as the plaintiffs and the city. The former are city employes.

■ At a general city election November 4,1941, there was submitted an amendment to section 6 of article 6 of the city charter raising the salaries of city employes, requiring the council to appropriate money to pay the increase, and levy a tax therefor. The returns were canvassed and duly certified showing that the amendment was defeated by 29 votes. Plaintiffs brought this action alleging irregularities in canvassing the returns and prayed…
