Otto Studor prepared a petition wherein he alleged that A. R. Sheffield was liable to him in damages for personal injuries arising out of an automobile accident. Mrs. Elizabeth Sheffield, as the duly qualified executrix of the estate of 'Otto Studor, filed a written motion “to be made party plaintiff in this ease,” alleging that “on May 20th, 1933, . . service of said petition and process was acknowledged and time of filing waived by the defendant;” that on May 21, 1933, Otto Studor died; and that on May 22, 1933, “said original petition, with the entry of service and waiver of time of…
