In August, 1915, the Teeum-seh Cotton Oil Company, hereinafter referred to as the Tecumseh Company, agreed to sell to the Sherman-Cotton Oil & Provision Company, hereinafter referred to as the Sherman Company, three tank cars of cottonseed oil, to be delivered in November, 1915, at “35 cents per gallon, loose, f. o. b. Oklahoma common points, in tank cars of 160 barrels capacity each, to be furnished by buyers,” cars to be shipped and routed at “buyer’s option” and paid for. on “sight draft against bill of lading for invoice amount.” The contract was made subject to the rules of the…
