delivered the opinion of the court:

Plaintiff, Frank Tynatishon, Mayor of the Village of Milan, brought an action for declaratory judgment against certain Trustees of the Village of Milan. After the action was filed in the Circuit Court of Rock Island County all of the matters in controversy were settled except the claim by plaintiff that a contract with the City of Rock Island and the ordinances of the Village of Milan embodying such contract were void.
