*331Judgment, Supreme Court, New York County (Bonnie G. Wittner, J, at suppression hearing; Jeffrey M. Atlas, J, at jury trial and sentence), rendered May 5, 2004, convicting defendant of criminal possession of a controlled substance in the third degree, and sentencing him to a term of A1!2 to 9 years, unanimously affirmed.
