On May 29, 1940, the People of the State on the relation of Jesse J. Hill, John L.. Howie and William F. Canavan, filed a complaint in the circuit court of Macon county, alleging the invalidity of an ordinance enacted August 31, 1939, by the city council of Decatur, vacating West William street between Summit and Woodlawn avenues and seeking a writ of mandamus compelling the restoration of the street to public use. Franzy Eakin, Forrest Eakin, Jeannette A. Buck, Alan N. Buck, the city of Decatur, Charles E. Lee, mayor, and each of the commissioners of the city were made parties defendant. By…
