The appellant bank sued Bolin on a note for $383.50, dated December 1, 1913, providing for interest and attorney fees. Bolin pleaded non est factum, and the jury, in response to a single special issue, answered that he did not execute the note sued on.
Appellant's first assignment complains of the trial court's action in overruling his challenge for cause to the juror, L. E. Williams. Appellant rejected this juror with a peremptory challenge and exhausted all of its challenges in the selection of the jury.
